Boomger End User License Agreement (EULA)

Introduction

This End User License Agreement ("Agreement") is a legally binding agreement between you ("User," "you," or "your") and Boomger ("Company," "we," "us," or "our") governing your use of the Boomger mobile application ("App").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

If you do not agree to the terms of this Agreement, you must not use the App.

1. Scope of License

Boomger grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App for your personal, non-commercial use on devices that you own or control, and as permitted by applicable app store usage rules and terms of service.

2. Restrictions

You agree that you will not, and will not attempt to:

Use the App for any commercial purpose unless expressly authorized by Boomger.
Copy, modify, decompile, reverse engineer, disassemble, or attempt to derive the source code of the App or any part thereof.
Create derivative works based on the App.
Sell, rent, lease, sublicense, distribute, or otherwise transfer the App to any third party.
Use the App in a manner that interferes with, disrupts, damages, or overburdens Boomger’s systems, servers, or networks.
Use the App for unlawful, harmful, abusive, or fraudulent activities, including misuse of the dating and community features.

3. Maintenance and Support

Boomger is solely responsible for providing any maintenance and support services for the App, as required by applicable law or as otherwise determined by Boomger. You acknowledge that Apple or any other app distribution platform has no obligation to provide maintenance or support services for the App.

4. Warranty Disclaimer

To the fullest extent permitted by law, the App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Boomger expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Where applicable law does not permit the exclusion of certain warranties, any such warranties shall be limited to the minimum extent required by law, and Boomger (not Apple or any third party) shall be solely responsible for such warranties.

5. Product Claims

Boomger, and not Apple or any other app store provider, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:

Product liability claims.
Claims that the App fails to conform to applicable legal or regulatory requirements.
Claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

In the event of any third-party claim that the App or your use of the App infringes that third party’s intellectual property rights, Boomger (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

All intellectual property rights in and to the App, including but not limited to software, designs, logos, trademarks, and content, are owned by or licensed to Boomger.

7. Legal Compliance

You represent and warrant that:

You are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country.
You are not listed on any United States government list of prohibited or restricted parties.
You will comply with all applicable local, national, and international laws and regulations while using the App.

By downloading, installing, or using the Boomger App, you confirm that you have read, understood, and agree to be bound by this End User License Agreement.
